Rent Agreements in Gurgaon: What Actually Matters

Most rent agreements in India are written for eleven months, and most people sign whatever template the owner produces without reading it. That template is written to protect the owner. It is not unfair to change it โ€” a rent agreement is negotiable like any contract, and the clauses that matter to a flat-sharer are usually the ones missing entirely.

Why is the agreement always for eleven months?

Because agreements of twelve months or longer attract compulsory registration under the Registration Act, which means fees, a visit to the sub-registrar and a paper trail. Eleven-month agreements avoid that, so they became the default across the country and stayed there.

A shorter term is not automatically worse for you. It does mean the rent can be revised at renewal, so if you expect to stay longer, ask for the renewal increase to be capped in writing rather than left open.

What should you check before signing?

The deposit amount and, more importantly, the return timeline. "Refundable at the end of the tenancy" is not a timeline. Ask for a specific number of days after handover.

What can be deducted from the deposit, and who decides. Normal wear and tear should not be deductible; painting charges frequently appear here and are worth questioning.

The notice period, and whether it is symmetrical. An agreement that requires two months from you and allows one from the owner is common and is negotiable.

Who pays maintenance, and whether it can change. In many Gurgaon societies maintenance is billed separately and rises annually.

How power backup is billed. DG charges are usually separate from both rent and maintenance, and in summer the difference is not trivial.

The lock-in period. If there is one, know what leaving early actually costs.

Whether subletting or adding a flatmate is permitted. This is the clause flat-sharers most often discover too late.

Who is named on the agreement. If three people share, all three named on one agreement is very different from one named tenant and two informal occupants.

What does a flat-sharer need that templates leave out?

A standard agreement assumes one tenant. Sharing introduces questions it does not answer: what happens when one person leaves mid-term, whether the remaining flatmates can choose a replacement, and how that person's share of the deposit is settled.

The cleanest arrangement is for every sharer to be named on the agreement, with each person's deposit contribution recorded. Then a departure is a substitution rather than a renegotiation.

Where only one person is named, everyone else is relying on that person's goodwill. That usually works, right up until it does not. If you are the unnamed party, at minimum get your deposit contribution acknowledged in writing by whoever holds it.

Do you need to register the agreement?

For a standard eleven-month agreement, registration is generally not required, which is exactly why that duration is used. Agreements of twelve months or more do require it.

Registration is not the only thing that gives an agreement weight. A properly executed agreement on stamp paper of the correct value, signed and witnessed, is what you want regardless, and it is what you will need if you ever have to prove the terms.

A rent agreement is also routinely asked for by employers for HRA claims, by banks and during police verification, so it is worth having a clean copy even where nothing is in dispute.

Common questions

Can a rent agreement in Gurgaon be for more than eleven months?

Yes, but agreements of twelve months or longer require compulsory registration, with the associated fees and process. That is the reason eleven months became the standard rather than any restriction on longer terms.

Is a rent agreement negotiable?

Entirely. The document the owner produces is a starting position, usually from a generic template. Notice period symmetry, deposit return timelines and permission to add a flatmate are all commonly amended when asked.

Should every flatmate be named on the agreement?

It is the safer arrangement. If only one person is named, everyone else has no direct standing with the owner and their deposit contribution is informal. Naming all sharers turns a departure into a substitution rather than a dispute.

Can the owner deduct painting charges from the deposit?

It depends entirely on what the agreement says, which is why the deduction clause is worth reading before signing. Normal wear and tear is generally not something a tenant should be paying to restore, but a clause you signed saying otherwise will govern.

General information, not legal advice. Rules and practice vary, and this is not a substitute for reading your own agreement or speaking to a lawyer where money is at stake.
